An Empty Draw Pile Needs a Stated Continuation Rule
An empty stock does not tell you what happens next. A card game may end the hand, rebuild the stock or use another specified procedure. Those procedures lead to different positions.

Consider a practice rule that keeps the top discard visible and shuffles the older discards into a new stock. The top discard stays outside the shuffle. If the discard pile contains only that top card, there are no older discards available to rebuild the stock.
Count the cards eligible for the new pile before continuing. Do not quietly include cards from players' hands or return the protected top discard just to make a draw possible. The rule must explain the empty-pile case too.
